Electronic Data Contribution Requirement

Full or Corporate Membership with NACM South Atlantic allows members to access NACM credit reports and Industry Credit Group information. NACM is founded on the principle of sharing current commercial credit experience for the benefit of the credit community.

Full and Corporate Memberships are required to contribute trade payment data to the NACM National Trade Credit Reporting Database through Electronic Data Contribution. Notice to Owner Membership and Non-Member Accounts are not subject to this requirement.

Electronic Signature Consent

By completing and submitting this application electronically, you consent to the use of electronic records and electronic signatures. You agree that typing your name in the Electronic Signature field constitutes your electronic signature and signifies your intent to sign this application and be bound by the acknowledgments, certifications, Terms and Conditions, and other agreements contained herein to the same extent as if you had signed the application by hand.

Terms and Conditions

General

  1. NACM provides credit information through the NACM National Trade Credit Report. NACM does not guarantee the accuracy of the information furnished to members. NACM treats data gathered in good faith as confidential and privileged communication and is not liable for negligence in procuring, collecting, communicating, or failing to communicate the compiled information. Member agrees to receive and accept all reports on said basis.
  2. Members are responsible for making their own credit decisions and additional investigations as necessary. NACM may furnish information from members, public records, or other sources considered to be reliable. Such information may not be complete, and the member must assume all risks involved in acting upon the material presented. NACM may supply additional information, to the best of its ability, or individual items when requested by the member.
  3. All information must be held in strict confidence within the Credit Department, and the member must use it for credit purposes only. If NACM receives conclusive evidence that this confidential information is misused, NACM reserves the right to cancel membership without recourse or refund. You may never disclose details from an NACM Credit report to anyone outside your credit department or company management.

Credit Reporting

  1. Credit reporting pricing is in effect for twelve (12) consecutive months unless otherwise specified in writing.
  2. "Data Contributor" means an agreement to contribute monthly accounts receivables aging information in electronic form in .txt or .csv file format. The data contribution must begin before receiving any data contributor discount offered by NACM.
  3. Credit report pricing is based on direct access through our website for reviewing customers and prospective customers in the ordinary course of business.
  4. Member agrees that all information submitted to NACM shall be a complete and accurate representation of the member's business experience with the subject or the credit inquiry.
  5. Discounted pricing offered for data contribution will be withdrawn after sixty (60) days of non-compliance.

Notice to Owner

  1. All Notice to Owner services will be charged at the rate shown on the current rate sheet or on page one of the member application. Rates are in effect for twelve (12) consecutive months unless otherwise specified. Postal fees are subject to change.
  2. Direct Access NOC billing, if used, is invoiced monthly. NACM will be held harmless from any responsibility associated with the member company choosing and using any specific NOC found in the database.
  3. AGENT AUTHORIZATION. This agreement authorizes NACM to act as our agent in preparing all notices, including those notices under Chapters 713 and 255 of the Florida Statutes.
  4. HOLD HARMLESS AGREEMENT. NACM will prepare and attempt to serve a Notice to Owner and Notice to Contractor (notices) based on the information furnished. NACM will make every effort to research, prepare, and serve a Notice to Owner as requested. In requesting notices, we waive and relinquish all claims or rights we may have against NACM based upon its action or that of its officers, employees or agents. This waiver includes damages and losses we may sustain by any act, negligence, mistake or deviation in the performance of these services, including but not limited to researching, preparing, and serving the Notices on our behalf. In waiving our right to claim damages as set forth above, we agree that the sole remedy for NACM's failure to properly or timely serve a notice for us shall be for NACM to refund or otherwise credit our account for any charges or fees assessed against us by NACM for serving or attempted serving of said Notice to Owner. In any event, at no time shall NACM's liability exceed the sum of $1,000 per request. The consideration received by the undersigned member for this agreement is the reasonable price charged by NACM for the service and other valuable consideration, the receipt and sufficiency of which is hereby acknowledged.

Payment terms are net EOM. Legal action may be brought in Orange County, Florida, or other applicable venue as stated in the terms.
